Kentucky Assistive Technology Services (KATS) Network Assistive Technology Resource Guide

Under the Individuals with Disabilities Education Act (IDEA), public school systems are required to provide a Free Appropriate Public Education (FAPE) to eligible students with disabilities. This includes consideration of assistive technology (AT) devices and services when necessary for a student to access, participate in, and benefit from their educational program.

Kentucky public school districts are responsible for ensuring that students with disabilities receive individualized educational services based on their unique needs. Assistive technology may be provided when determined necessary by the Admissions and Release Committee (ARC) through the student’s Individualized Education Program (IEP).

The Kentucky Department of Education, Division of Learning Services, provides guidance and technical assistance to local school districts regarding special education services, including assistive technology supports and services.

Eligibility Requirements and Application Process

Students may qualify for assistive technology services through special education if:

• The student is determined eligible for special education services under IDEA;
• Assistive technology is considered necessary for the student to receive FAPE; and
• The need for assistive technology is documented within the student’s IEP.

Federal law requires that assistive technology be considered for all students receiving special education services.

The need for assistive technology is typically identified during the IEP/ARC process. Evaluations, observations, classroom performance data, and input from educational staff, related service providers, and families may be used to determine whether assistive technology is necessary.

If the ARC determines that assistive technology is required for the student to receive FAPE, the school district is responsible for providing the necessary devices and/or services identified within the IEP.

AT Services Provided/Covered

School districts may provide:

• Assistive technology evaluation and assessment;
• Device trials and recommendations;
• Purchasing or acquisition of assistive technology;
• Device customization and selection;
• Coordination of educational supports and services; and
• Training and technical assistance for students, staff, and families.

Assistive Technology Provided/Covered

Assistive technology identified as necessary within the student’s IEP may be provided by the school district. Depending on educational need, this may include:

• Communication devices;
• Computer access technology;
• Reading and writing supports;
• Mobility and positioning supports;
• Vision or hearing supports; and
• Other educational assistive technology tools and services.
